Welcome to Stone Creek Entertainment, the publisher of online, mobile and social games including the Karizmac™ suite of games. Stone Creek Entertainment Inc. ("Stone Creek Entertainment" "we," or "us") is concerned about your privacy and we provide this privacy policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of the websites we own and operate, namely www.karizmac.com (each a "Site") and the games, forums and applications (collectively "Games") we provide on the Site or through other websites. The Games and the Site together are called the "Services". This Privacy Policy applies only to information collected through the Services.

By visiting this Site or using the Services, you are accepting the policies and practices described in this Policy, as such policy may be amended from time to time. Each time you visit the Site or use the Services, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Policy. We may update the Privacy Policy and if we do, we will not post a notice that changes have been made on the website. You should visit this page periodically to review any changes to the Privacy Policy.

To be clear about the terminology we are using, when we use the phrase "Personal Information" in this Policy, we mean information about you that is personally identifiable, like your name, address, e-mail address, or phone number, as well as other non-public information that is associated with this personal information. When we use the phrase "Anonymous Information" in this Policy, we mean information that is not personally identifiable, or linked to your Personal Information. Anonymous Information does not enable identification of individual persons.

ADDITIONALLY, YOU UNDERSTAND THAT YOUR PERSONAL INFORMATION MAY BE TRANSFERRED TO AND PROCESSED IN COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING PERSONAL INFORMATION MAY BE LESS STRINGENT THAN IN YOUR COUNTRY.

The Information We Gather

We collect information about you in a number of ways:

We collect and maintain information that you voluntarily submit to us during your use of the Sites and Services. For example:

  • when you register for the Site or one of our Games, you may provide us certain information including your name, email address, screen name and/or password;

  • if you establish a profile as part of the Services, we will collect any information that you include in the profile;

  • any information you provide us as part of the Game (including any actions taken during the Game and interactions with the Game) may be collected

  • if you elect to register for a certain feature of function (e.g., a newsletter) we may collect information from you

  • if you participate in one of our surveys or enter a sweepstakes or contest, we will collect the information that you provide

  • you may provide us with personal information in the course of email, customer support or when you submit a post to a Forum

  • if you purchase a product or service through the Site or one of the Services (including Virtual Currencies or Virtual Goods as defined in our Terms of Service), a third party vendor may collect payment and/or credit card information on our behalf.

You may choose not to provide us with certain information, but this may stop you from gaining access to a Service or limit the features that you can use.

You may request data deletion. You may request that any personal data we receive from you be deleted from our database or that your account be deleted. However, by deleting your account, data or information, all Game progress and any virtual goods or currency paid for and/or earned, if any, may be terminated; and such deletion may stop you from gaining access to the Games or limit features that you can use. To confirm a deletion request we need you to send us an email to with the subject line “Data Deletion Request” in order to confirm that this request is on your own behalf and related to your use of the Games. In this email, please provide your name (as it appears on the Game account); your Facebook user ID; your email address; and the account, data or information you would like deleted. If you do not know your user ID on Facebook, you can log into your Facebook account. At the top of the Facebook page there is a tool bar with items such as Home, Profile, Friends. Click on Profile. At the top of your browser, you will see a URL and the number at the end of the URL is your Facebook user ID. Even after you remove information or delete your account, copies of that information may remain viewable elsewhere to the extent it has been shared with others, it was otherwise distributed, or it was copied or stored by other users.

As you use the Site and Services, certain information may also be passively collected. Through technologies like cookies, pixels, beacons and log files, we may collect information about how you use the Services. Please see the sections below on Cookies and Log Data for more information.

We may receive information from third parties. For example, we may receive Personal Information about you from a website that is sponsoring a Game or from a social networking website through which a Game is displayed. In such a case, the third party will notify you that we will have access to your information and the policy that governs our use of your information (e.g., their privacy policy or ours.)

How We Use Your Information

We will use your Personal Information in the ways described below or described at the time that the information is collected.

In general, we use your Personal Information as necessary or appropriate to:

  • administer your account;

  • provide you with customer support;

  • register you and provide you access to the Site or Services;

  • perform the Services (e.g., operate the Game)

  • respond to your inquiries or requests that you direct to us;

  • send communications and administrative emails about the Site or Services;

  • personalize and better tailor the features, performance and support of the Services for your use;

  • send you promotional/marketing information, newsletters, offers or other information

  • provide you with opportunities and functionality that we think would be of particular interest to you;

  • improve the quality of the Site and the Services, and

  • analyze, benchmark and conduct research on, user data and user interactions with the Services

Log Data. When you use the Services, whether as a registered user or a visitor (each a "User"), our servers automatically record information from your browser ("Log Data"). This Log Data may include information such as your computer's Internet protocol address (more commonly known as an IP address), browser type, the webpage you were visiting prior to your arrival at the Service, the pages of our Services that you visit, the time spent on those pages, access times and dates, and other statistics. We use this information to monitor and analyze use of the Services, for their technical administration, to increase their functionality and user-friendliness, and to better tailor them to the needs of our Users. We also use this information to verify that visitors to the Services meet the criteria required to process their requests. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information.

Cookies: Like many websites, we use "cookies" to collect information. A cookie is a small data file that we transfer to your browser for record-keeping purposes. We use cookies for two purposes. First, we may utilize persistent cookies to save your registration ID and login password for future logins to the Site or Games. Second, we utilize session ID cookies to enable certain features of the Services, to better understand how you interact with the Services and to monitor aggregate usage and web traffic routing on the Site and Services. Unlike persistent cookies, session cookies are deleted from your computer when you log off from the Services and then close your browser. Third party advertisers on the Services may also place or read cookies on your browser. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions or functionalities of the Site or Services. Any Personal Information gathered through the use of cookies is subject to the same efforts to protect your privacy as outlined above.

How We Share and Disclose Information

We know how important it is to keep the information you've entrusted to us confidential. We will not rent, sell or share your Personal Information with third parties except as specifically approved or under the circumstances described below. If you do not want us to use or disclose Personal Information collected about you in the ways identified in this Policy, you should not use the Site or Services.

Stone Creek Entertainment Users. When you register to become a registered user, submit your Personal Information to create a profile, join one of the Services, or play one of our Games, other Users may see your username and other Personal Information. Some Services may allow you to control what information you display to others. Any information you choose to provide should reflect how much you want other Stone Creek Entertainment Users to know about you. We recommend that you guard your anonymity and sensitive information and we encourage you to think carefully about what Personal Information you disclose in your profile pages and in any forums. We recommend that you not use your real name as your username, since that would allow others to identify you.

Service Providers. We may employ third party companies and individuals to facilitate or enhance our Site or Services, to provide the Services on our behalf, to perform tasks (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Site or Services) or to assist us in analyzing how our Services are used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Sponsors - and other ways that you approve at the time of collection. We may collect Personal Information about you and share it with third parties to the extent that you give us permission at the time of collection. For example, we sometimes gather Personal Information that is shared with a sponsor. In such a case, we will provide you clear notice at the time of collection that the information will be shared with the sponsor and link to the sponsor's privacy policy. The third party is contractually obligated to comply with its privacy policy. The sponsor of any Game, if any, is identified in the section Important Information about Particular Services.

Contract Partner Sites. When you access a Game through a website operated by any entity other than us (e.g., the iTunes App Store, a social networking site like Facebook or one of our sponsors), we call that site a Contract Partner Site. Unless we clearly indicate otherwise at the time of collection, we do not share Personal Information with Contract Partner Sites. Please be aware however that our Contract Partner Site may collect information about you. In addition, we often use the Contract Partner Site's authentication functionality (e.g., username and password) to provide you access to our Game and as a result of the authentication process or simply by virtue of your presence on the Partner Site, the Partner Site may be able to collect information about you and/or the way you interact with the Game. Please see the Contract Partner Site's privacy policy to better understand what information is collected, how it is used and shared, and your choices regarding control. The Contract Partner Site associated with any Game, if any, is identified in the section Important Information about Particular Services.

Aggregated, Anonymous Information. We may share aggregated Anonymous Information about you with third parties. Aggregated information is your Anonymous Information that is combined with the Anonymous Information of other users and does not allow you to be identified or contacted. Depending on the circumstances, we may or may not charge third parties for this aggregated information, or limit the third parties' use of the aggregated information.

Compliance with Laws and Law Enforcement. We will disclose any information about you to government or law enforcement officials or private parties as we in good faith believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to comply with applicable laws, to protect the property and rights of Stone Creek Entertainment, you or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, any illegal, unethical or legally actionable activity.

Within our Company; Changes to our Company. We may share all or some of your Personal Information with any of our subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Policy. Additionally, in the event we go through a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge that such transfers may occur and are permitted by this Policy, and that any entity that acquires us, is merged with us or that acquires our assets may continue to process your Personal Information as set forth in this Policy.

Forums, Message Boards and Chats

We may make message boards, chat rooms, and other interactive forums available as part of the Services. You should be aware that any information which you post to these interactive forums or otherwise choose to make publicly available, including your Personal Information, may be disclosed and available to all users who have access to that portion of the Services, and is therefore no longer private and confidential. You should be aware that any personally identifiable information you submit in the course of these public activities can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these forums. If you post a video, image or photo on one of our Sites for public view you should be aware that these may be viewed, collected, copied and/or used by other users without your consent. By using these interactive forums, you agree that we are not responsible for any information that you disclose or communicate in such forums, and any disclosures you make are at your own risk. Please be thoughtful about what you post and make publicly available through the Services. We may maintain copies of any information you post indefinitely, or delete certain information in whole or in part if we determine, in our sole discretion, that such information constitutes an “Infringing Posting” or a “Prohibited Posting” as defined in our Terms of Use or for any or no reason. You are solely responsible for your interactions with others you interact with in our Services. You understand and agree that we do not screen our users, nor do we inquire into the backgrounds or attempt to verify the statements of our users, except as provided for herein with respect to children under 13 years of age. You agree to take reasonable precautions in all interactions with other users of our Services. You should not provide financial information (for example, your credit card information or bank account information) to other users of our Services.

Children's Information

The Site and Services are not directed or intended for children under 13 years of age. We do not knowingly collect or solicit Personal Information from individuals under 13 years of age, or knowingly allow such persons to register. No one under age 13 may provide any personal information to or on the Site or one of our Games. If you are under 13 years of age, you should not register or provide Personal Information through the Services. If we later obtain actual knowledge that a user is under 13 years of age, we will take steps to remove that user's Personal Information from our systems. If you are the parent or guardian of a child whom you believe has disclosed Personal Information to us, please contact us at privacy@stonecreekentertainment.com so that we may delete and remove such child's information from our systems.

We strongly recommend that minors 13 years of age or older ask their parents for permission before sending any information about themselves to anyone over the internet and we encourage parents to teach their children about safe internet use practices. Important Information about Particular Services

  • HER PER PEEVES. HER PET PEEVES is a downloadable application designed for the Apple iPhone that allows girls to get out their frustruations by popping bubbles that have images of people and things that annoy them. We do not receive any Personal Information from the Apple iTunes App Store and we not share any Personal Information with our Sponsor. The forums for HER PET PEEVES may appear on other Contract Partner Sites, including Facebook.

  • KARIZMAC THE FLIRT GAME. The Karizmac The Flirt Game™ game is a dating game for virtual characters that is made available through our Contract Partner Site, The Facebook, and sponsored by MTV. The following information is related solely to the KARIZMAC THE FLIRT GAME™ game:

    1. (a)The Information we collect. Except as specifically provided in this section, we collect information as provided in The Information We Gather section above. We collect your email address if you authorize Facebook to provide it to us. Your email address is Personal Information. We do not require you to register in order to use the Game. In order to access the Game you must be logged into your Facebook account. Once logged in, and you appear at the Game home page, Facebook passes us a token with a Facebook User ID that we use to understand that you are a Facebook user and, subject to our Terms of Use, eligible to access the Game. The Facebook User ID is associated with other information about you (e.g., your age, your Facebook User Name, collectively the “Facebook Information”) that we use to operate the Game. The Facebook Information is not Personal Information and we do not know who you are based on the information we receive from Facebook unless you have provided us your email address. If you have provided us your email address, we will associate your Facebook Information with your email address and all of the Facebook Information will also be considered Personal Information. By signing up to play the Game, you agree that user account information can be transferred to us. Information transferred may include your name, profile pictures, email address, User ID, gender, current city, language, and date of birth, as well as information pertaining to your pictures, connections and friends’ lists shared using the Everyone privacy setting in Facebook, but does not include credit card number or other financial account information.

      In addition to this Personal Information, when you play the Game you will create a character and that character will be associated with information that is personal to it (“Character Information”). For example, you will choose an avatar for your character and you will imbue the character with likes, dislikes and compatibilities of the character. The way that Character Information is collected, used and disclosed within the Game is described in the Game tutorial available through the Game itself.

    2. (b)How we use and disclose the Karizmac The Flirt Game™ Personal Information. We use and disclose the Personal Information collected through the Game as set forth in this Privacy Policy. Having said that, we add the following:

      • *the Character Information, including your character’s likes, dislikes and compatibilities, is information associated with your character – and not necessarily you. But still we understand, indeed intend, that there will be overlap between your likes and that of your character. So we ask that you are thoughtful about what information you share about your character through the Game, as other’s may use the information for purposes other than you intended – including nefarious purposes. In addition, to be clear, Character Information is not your Personal Information. As established in the Terms of Use, we reserve the right to use any Character Information in any manner we choose and disclose any Character Information to any third party so long as the character is not associated with your Personal Information. For example, by accessing the Game, you acknowledge and agree that we may randomly select and feature you as the “Date of the Day” by including your avatar name and your avatar, but not your email address, to other users of the Game. As a result, other users of the Game may contact you through messages and comments. If you do not agree to these terms of our Privacy Policy, please do not access and use the Karizmac The Flirt Game™ game.

      • *players of the Game may elect to friend each other through Facebook and communicate outside the context of the Game including through Facebook’s in-browser email. We strongly discourage communication or in-person visits between players outside the context of the Game or virtual characters. We strongly encourage parents to be aware of how their teenagers interact with the Game, virtual characters and other players and ensure the teenagers do not use the Game for real-life interaction with others.

      • *when you create an avatar, the avatar is automatically associated and displayed with your Facebook User Name. Your Facebook User Name is not Personal Information per se, but it may contain your Personal Information. For example, if your real-life name is John Smith, your Facebook User ID (and avatar name) may be john.smith7. If you do not want your avatar associated with anything that might be tied to you personally, you can change your Facebook User Name through your Facebook account settings.

      • KARIZMAC LUMINOUS. Karizmac Luminous™ is a downloadable application designed for the Apple iPhone, Apple iPad and Apple iPod Touch that allows a woman to compare her decisions to those made by others including strong women in history and today. We do not receive any Personal Information from the Apple iTunes App Store. The forums for Karizmac Luminous™ may appear on other Contract Partner Sites, including Facebook.If you have any questions about our Privacy Policy for the above particular Services and Games, please write to privacy@stonecreekentertainment.com.

        Please keep in mind, KARIZMAC LUMINOUS™ is a game created by Stone Creek Entertainment Inc. for your enjoyment solely as an entertainment and learning experience. Nothing contained in the Game is intended to be nor should it be construed as an actual evaluation of your personality traits. Any feedback or responses you receive from us during gameplay does not constitute advice or therapy nor does it constitute an endorsement in any manner from any of the renowned women featured or quoted in the Game. Any statement or testimonial by the renowned women that matches your profile is purely coincidental and does not constitute a prediction or evaluation of your mental, physical, emotional or social status.

  • WOMEN LEAD THE WORLD. WOMEN LEAD THE WORLD is a downloadable application designed for the Apple iPhone that allows a woman to compare her decisions to those made by others including strong women in history and today. We do not receive any Personal Information from the Apple iTunes App Store. The forums for WOMEN LEAD THE WORLD may appear on other Partner Sites, including Facebook.

Third Party Links

TThe Services may link to websites operated by third parties that we do not control. This includes any sites that you linked to from advertisements that appear on the Services. We do not monitor, control, or endorse the information collection or privacy practices of any third parties. We encourage you to become familiar with the privacy practices of every website you visit and to contact them if you have any questions about their respective privacy policies and practices. This Policy applies solely to information collected by us through the Services and does not apply to these third party websites. The ability to access information of third parties from the Services, or links to other websites or locations, is for your convenience only and does not signify our endorsement of such third parties, their products, services, websites, locations or their content.

Ad Networks and Third Party Cookies

We may have agreements with companies, sometimes called "Ad Networks" that serve advertising on the Services on behalf of third parties. These Ad Networks may place or recognize a unique cookie, sometimes called a "third party cookie," on your browser. Ad Networks use cookies to understand Web usage patterns of people who see advertisements, to control the sequence of advertisements you see, to provide you with the most relevant advertising, and to make sure you don't see the same ad too many times. Ad Networks may connect information about pages you visit through our Services with information about pages you visit on other sites and show you advertising based on this combined information. Changing or Deleting Your Information

If you are a registered user, you may review, update, correct or delete the Personal Information in your profile by changing the applicable information in your account settings or, for Games that are hosted on a Partner Site, by changing the applicable information in your profile page. Keep in mind, however, that even if you delete information from your profile, we may retain your Personal Information in conformance with our data retention policy and there may be residual Personal Information that remains within our databases, access logs, and other records. In addition, we are not responsible for updating or removing your Personal Information contained in the lists or databases of third parties who have been provided information as permitted by this Policy.

Security

Stone Creek Entertainment is very concerned with safeguarding your information. We employ administrative, physical and electronic measures designed to protect your information from unauthorized access. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored "personal data" (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on the Services in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

Performance of New Game Releases (alpha and beta)

At Stone Creek Entertainment, we may release alpha and beta versions of games – these are game versions that are still in testing phase and thus unintended privacy issues may occur. Please contact us if you have any concerns and we will rectify the problem as soon as possible. Stone Creek Entertainment does not guarantee error-free performance of new products in the testing phase.

Privacy Policy Changes
